Privacy Notice

I. Party responsible for the protection of your personal data

KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V., with its address at 4 Norte, No. Exterior: 1, Col. Santa Cruz Xonacatepec, Amozoc, C.P. 72994, Puebla, Mexico, is responsible for the processing of your personal data under the terms of Article 3, Section XIV of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP).

II. Purpose of processing and personal data collected

The general personal data of prospects and customers collected in person (at our offices) and directly (by telephone or email, web forms, social networks and mobile applications) will be used for the following essential purposes:

  1. Registration in our database;

  2. Compiling the customer’s file;

  3. Contacting you to follow up on your quote requests and to provide information about our accessories and services;

  4. Providing information about our new products;

  5. Providing customer service, and receiving and following up on complaints;

  6. Handling complaints filed by the customer with the Federal Consumer Protection Agency (PROFECO), creating a physical and electronic file for them and maintaining control databases of the complaints received. The complainant’s information (general data, as well as information about their equipment and accessories) and the file will be shared with a law firm for the legal handling of the proceedings;

  7. Sending satisfaction surveys;

  8. Conducting market research;

  9. Generating reports and de-identified statistics that allow us to develop business strategies to improve our products and customer service; maintaining the legal relationship between you and KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V.;

  10. Audits; and

  11. Updating your personal data.

a) Use of images. In order to document and communicate information about the company’s activities and installations, generate reports and de-identified statistics that allow us to develop business strategies to improve our products and customer service, and maintain the legal relationship between you and KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V., the company may use, print, reproduce and publish the image(s) (photographs and/or videos) of persons who purchase our products, provide spaces for showrooms or request installations of our products, as well as images published by our customers with references to our brand and products in which identifiable persons appear (depending on the terms and requirements of the call), newsletters, photographic records and publications, in all their forms, performances, editions, broadcasts, phonograms or videograms, for exclusively informative and journalistic purposes under the terms of Article 87 of the Federal Copyright Law. If customers or prospects publish photographs with images that include identifiable persons, they guarantee that they have the authorization of those persons to publish the image or photograph.

Likewise, we may republish within the same Social Networks the images that visitors or followers publish on our profile, in order to share our followers’ experiences. KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. will not disclose, use or commercially exploit the images or photographs published by users on their personal accounts (or their “Profile”) within the Social Networks, nor the images shared or published by participants in our contests, events or activities. If any of these images is suitable for advertising use, we will contact you to request your express consent under the terms of Article 87 of the Federal Copyright Law.

b) Website. The information that our visitors voluntarily post on the Wall or send via “Inbox” or “DM” (direct messages) within the Official Social Networks and website of KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. is subject to the terms and conditions set by the provider of the social network in question. For prospects or customers who contact us through this channel, the general personal data they provide will be used to: stay in contact with you; answer your questions, suggestions and requests; provide you with information, and follow up on and route your requests; and integrate your information into systems or databases. Your information may also be used to send advertising, promotions, discounts, event invitations and information from our authorized Distributors. When visitors or followers of the Official Social Networks of KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. take part in one of our contests, we may ask them to provide general personal data in order to: deliver prizes; keep evidence or support of the activities carried out, compliance with the rules of our contests and the delivery of prizes; and for audits.

c) Non-essential purposes. We inform you that your general personal data will be used for the following secondary purposes: commercial prospecting; sending advertising, promotions or discounts from KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. and/or our business partners, newsletters, event invitations, information on financing, technical campaigns for your property, quotes, greetings and recall notices.

III. Consent for the processing of sensitive, financial and property-related personal data

In compliance with Articles 8, 9 and 16 of the LFPDPPP, KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. informs you that, to carry out the purposes described in Section II of this Notice, we do not collect or process sensitive, financial or property-related personal data. If such data is provided, written consent for it is required through this privacy notice.

IV. Transfers of information

There will be no transfer of data, except in the cases provided for in Article 37 of the LFPDPPP, unless such transfers are requested; in that case, written consent is required through this privacy notice.

V. Rights of Access, Rectification, Cancellation, Opposition and revocation of consent (ARCO Rights)

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties, you may request from KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. access to, rectification of or cancellation of (where legally applicable) the personal data you have provided, or object to its use, as well as revoke your consent. To do so, please follow the procedure below:

Send an email to info@theredsquareheating.com stating: your full name; your current or past relationship with KLEIN HOME SOLAR-HEAT-INTEGRATIONS S.A. DE C.V. (where applicable, stating that you are or were a prospect or customer); the data for which you request access, rectification, cancellation or opposition, or for which you wish to revoke your consent; and attaching a copy of an official ID to prove your identity or the capacity in which you make the request. You must also attach any documents relevant to the request. For rectification requests, the data subject must state precisely what change should be made, attaching the documentation that supports the request.

  1. Once your request is received, you will be sent an Acknowledgment of Receipt with the corresponding date of receipt. If your request does not meet the legal requirements, within five business days of its receipt you will be asked to correct it within ten days; otherwise, it will be deemed not submitted.

  2. If your request is sent on a non-business day, it will be considered received on the following business day.

  3. Your request will be answered by email within twenty business days from the date of the acknowledgment of receipt. This period may be extended by an additional twenty days when justified; the data subject will be notified of this in accordance with Article 97 of the Regulations of the LFPDPPP.

  4. If your request is admissible under the LFPDPPP and other applicable regulations, access will be granted, your data will be rectified or cancelled, your right of opposition will be given effect or your consent will be deemed revoked within fifteen days of the date on which your request is answered. This period may be extended by an additional fifteen days when justified; the data subject will be notified of this in accordance with Article 97 of the RLFPDPPP.

In all cases in which your request is admissible, under Articles 32, 33, 34 and 35 of the LFPDPPP, your personal data will be delivered free of charge to the email address designated by the data subject for this purpose. If you require the information to be delivered in another way, you will only need to cover the justified shipping costs and/or the cost of reproduction in copies or other formats.

VII. Who can you file complaints with for the improper processing of your personal data?

If you believe that your right to the protection of personal data has been harmed by any act or omission of our employees, or by our actions or responses, or you presume that the processing of your personal data violates the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, you may file the corresponding complaint with the Secretaría Anticorrupción y Buen Gobierno (Ministry of Anti-Corruption and Good Governance), the authority that took over the functions of the former National Institute for Transparency, Access to Information and Personal Data Protection (INAI). VIII. Changes to the Privacy Notice

This Privacy Notice will be in force as of the date of its last update and may be modified by the responsible party in accordance with applicable regulations; any change will be communicated to the email address you provided.
